⁺‧₊˚ ཐི Terms of Service ཋྀ ˚₊‧⁺

⋆⁺₊⋆ General ToS⋆⁺₊⋆

• Commissions are for personal use only. Artwork created by me can be used as profile pictures/banners & device wallpapers, but may not be used in any way for profit.

• I have every right to decline any commissions I feel I cannot achieve at my current skill level or would contain subjects on my “won’t draw” list. I also have the right to refuse any commission without giving a reason for doing so.

• I own all rights to the work I create. Turning my work into a non-fungible token (NFT) or using it to train any AI bot or process is strictly prohibited.

• My work may not be traced for any reason. My work can only be referenced with explicit permission from me.

• Artwork you’ve commissioned me for can be reposted and shared with credit to my Instagram (@batfxngs).

• I typically post commissions on my social media accounts and Carrd with the commissioner’s username/name credit. I will also put character references and commissioner username/names on my Trello. If you do not want me to post your commission or include your username/name, please let me know!

• When commissioning me, please try your best to find/create clear visual references to provide me. I can work from a written description, but working from visual references ensures I can better guarantee I can fulfill your request and avoid any mistakes in the process!

• I will not work off of AI references. If I suspect a reference was made using AI, I have the right to refuse the commission.

⋆⁺₊⋆ Payment⋆⁺₊⋆

• I accept Cashapp, Venmo, and PayPal, but prefer Cashapp!

• Payment can either be made in full or through a non-refundable deposit of at least 50% of the total commission price. If a 50% deposit is made, the remainder of the balance must be sent after the sketch has been approved.

• I’m willing to discuss payment plans for commissions over $80, but prefer and appreciate if you can pay in full!

• The prices on my Carrd are the base price. This price can increase based on chosen/specified details. If these details are not communicated or paid for, I may work on/complete a commission that does not meet your standards. If this happens, I am willing to do a paid revision at a price of 20% the original cost of your commission.

• If you need to cancel your commission for any reason AFTER paying the 50% deposit, BEFORE the sketch has been approved, I will provide a partial refund (I will keep a minimum of 25% of the total commission cost).

• In the rare event I cannot complete a commission, I will do all in my power to provide a full refund, no matter how much of the commission I’ve completed. I will also send you whatever I have completed up to that point.

⋆⁺₊⋆ Process⋆⁺₊⋆

• Once payment is received, I will begin working and send a sketch for your review.

• Once the sketch is approved (and, if needed, the remaining half of the payment has been received), I will continue working. After the sketch has been approved, refunds may not be requested unless issued by me.

• full resolution PNG of the final piece will be emailed when completed. A watermarked JPEG for posting on social media will also be sent. I can also send the finished files through an alternate method (like Discord), just let me know!

• No physical product will be delivered unless otherwise discussed.

⋆⁺₊⋆ Communication⋆⁺₊⋆

• When the drawing process is underway, I send updates per your request (you can specify I be sparse in my communication or keep you more in the loop). Typically, I will communicate with you to send an update after every major change (lineart, flat colors, render)!

⋆⁺₊⋆ Revisions⋆⁺₊⋆

• When the commission is finished, I will send a screenshot of it for final review. If you wish to change anything at this point, three (3) minor revisions can be requested. Any more than three (3) revisions will incur an additional fee of (15% of the full commission price) which must be paid in full before I make adjustments.

⋆⁺₊⋆ Turnaround/Deadlines⋆⁺₊⋆

• My turnaround time is typically one (1) week—but I put a lot of time, effort, and care into every piece of art I create, so please be patient while I work on your commission!

• I have chronic pain and an unstable home life, which can unfortunately have a big impact on my motivation/ability to work. Because of this, I may take three (3) months maximum to complete a commission in the case unexpected events arise.

• If you’d like your commission by a specific deadline, please message me to discuss a rush fee!

• I usually don’t mind sending frequent updates, but please do not bombard me with requests for updates. If I feel pressured or rushed by update requests, I may cancel the commission and refund any payment that has been sent so far.
